L-2 spouse and children

The L-1 strategy should protect the family’s status, work, study, and timing.

A qualifying spouse and unmarried children under 21 may accompany or follow an L-1 worker in L-2 status. The family plan should coordinate visa processing or status filings, admission records, spouse employment documentation, travel, extensions, and each child’s age-out timeline.

The central L-2 questions

  • Does the principal applicant hold or seek valid L-1 status for the relevant period?
  • Is each dependent a qualifying spouse or an unmarried child under 21?
  • Will the family apply for visas abroad, request status through USCIS, or coordinate different routes?
  • Do passport, visa, approval-notice, and I-94 dates support the family’s intended stay and activities?

Coordinate the family record

  • Document the marriage or parent-child relationship with complete civil records and accurate translations where required.
  • Keep the principal L-1 approval, employment evidence, passports, visas, and each family member’s admission record consistent.
  • Confirm that a spouse’s Form I-94 carries the correct L-2S classification before relying on status-based employment authorization.
  • Track children’s birthdays, school plans, travel, passport validity, and any need to move to an independent status before age 21.
01

Distinguish a visa from status inside the United States

An L-2 visa is generally used to request admission at a U.S. port of entry. The period of authorized stay inside the United States is controlled by the admission record or a later USCIS approval, not simply by the visa stamp’s expiration date.

After every entry, each family member should review the electronic Form I-94 for the correct name, classification, and expiration date. A shortened admission caused by passport validity or an incorrect classification can change the family’s filing and travel plan.

02

Verify the spouse’s employment documentation

Certain L-2 spouses are employment authorized incident to valid L-2S status. The practical issue is whether the spouse has acceptable documentation for Form I-9 purposes, including an admission record that properly identifies the person as an L-2 spouse.

An L-2 child is not employment authorized merely because of L-2 status. The family should not treat the spouse and child classifications as interchangeable, even when their visa foils or older records look similar.

03

Plan extensions, travel, and children’s age-out dates together

Dependent status normally cannot extend beyond the principal worker’s valid L-1 period. A family may also face different passport expiration dates, consular appointments, travel needs, and USCIS processing timelines, so one person’s filing should not be planned in isolation.

An unmarried child generally ceases to qualify for L-2 status at age 21. School attendance does not stop that age-out. If the child needs to remain in the United States, an independent immigration route should be evaluated early enough to avoid a status gap.

Facts and procedure determine the route.

L-2 eligibility depends on the qualifying family relationship and the principal worker’s L-1 status. Spouse employment authorization requires the correct status and acceptable evidence; children are not employment authorized incident to L-2 status. Travel, admission, extensions, and any age-out transition require case-specific review.

Issues to resolve before filing.

Can an L-2 spouse work in the United States?

Certain L-2 spouses are employment authorized incident to valid status. The spouse should confirm that the Form I-94 shows the L-2S classification and that the available documents satisfy current Form I-9 requirements before beginning employment.

Can an L-2 child work?

L-2 children are not employment authorized merely because they hold L-2 status. Any proposed employment requires a separate lawful basis.

Can an L-2 child attend school?

L-2 children may generally attend school while maintaining valid dependent status, but schooling does not extend status or prevent age-out at 21.

What happens when an L-2 child turns 21?

The child generally no longer qualifies as an L-2 dependent and must timely obtain another lawful status or depart. Planning should begin well before the birthday.

Does an unexpired L-2 visa prove lawful status?

Not by itself. The visa supports a request for admission; the Form I-94 or a later USCIS approval normally controls classification and authorized stay inside the United States.

Describe your situation and the decision you need to make.

For an initial inquiry, briefly describe:

  • The foreign and U.S. companies involved, their relationship, and the employee’s role.
  • The employee’s work history and any existing L-1 petition or decision.
  • The intended transfer date, current location and status, and any response deadline.

A short summary is enough. Send no passport numbers or confidential documents.
