EB-2 national interest waiver

A national interest waiver case begins with the proposed endeavor—not a résumé.

An NIW petition must first establish the underlying EB-2 classification through an advanced degree or exceptional ability. It must then show that the proposed endeavor has substantial merit and national importance, that the person is well positioned to advance it, and that waiving the job-offer and labor-certification requirements would benefit the United States.

Separate EB-2 eligibility from the waiver test

  • Does the person qualify as an advanced-degree professional or through exceptional ability under the EB-2 framework?
  • Is the proposed endeavor specific, credible, and broader than the ordinary value of the person’s occupation?
  • Can the record establish prospective national importance through the endeavor’s likely implications rather than geographical reach alone?
  • Do education, progress, plans, support, resources, and past achievements show that the person is well positioned to advance the endeavor?

Prove the endeavor and the person’s capacity to advance it

  • Define the proposed U.S. work, its objectives, implementation plan, and expected impact with precision.
  • Use objective records to establish progress, adoption, investment, revenue, research, influence, demand, or institutional support where applicable.
  • Connect expert and stakeholder letters to verifiable facts rather than unsupported conclusions.
  • Explain why, on balance, the United States would benefit from waiving the job-offer and permanent labor-certification requirements.
01

Establish the underlying EB-2 classification first

A national interest waiver does not replace the threshold EB-2 requirement. The petitioner must establish qualification as an advanced-degree professional or as a person of exceptional ability before USCIS reaches the waiver analysis. Education, progressive experience, the proposed occupation, and any exceptional-ability criteria should be mapped to that threshold separately.

The proposed endeavor must also fit the area of expertise used to establish EB-2 eligibility. A strong academic or professional history in one field does not automatically support a materially different U.S. endeavor.

02

Define national importance through prospective impact

The value of an occupation and the national importance of a particular endeavor are different questions. The petition should describe what the person intends to do, how the work will be carried out, who may use or benefit from it, and what broader implications are reasonably supported by the evidence.

Geographic reach is not the only measure. An endeavor may have national importance through economic effects, public health, research, education, technology, infrastructure, industry practices, or another supported impact, but generalized claims about a useful field are weaker than evidence tied to the specific plan.

03

Show capacity, momentum, and the benefit of waiver

Being well positioned does not require guaranteed success. Relevant evidence can include education, a record of related achievements, demonstrated progress, intellectual property, funding, contracts, customers, institutional support, a feasible implementation plan, and access to the resources needed for the work.

The final inquiry is whether, on balance, it would benefit the United States to waive the job-offer and labor-certification requirements. The argument should address the facts of the endeavor and the petitioner rather than assume that self-petitioning is itself the reason a waiver should be granted.

Facts and procedure determine the route.

NIW is discretionary and fact-specific. An advanced degree, strong résumé, socially useful occupation, or successful business does not automatically establish national importance or the remaining waiver factors. Visa availability and the green-card stage are separate issues.

Issues to resolve before filing.

Is an employer required for an NIW petition?

No. A qualifying person may self-petition, although employment, contracts, partnerships, funding, or other support may be important evidence of the proposed endeavor and ability to advance it.

Does work in healthcare or technology automatically have national importance?

No. The field may have substantial merit, but the petition must still show the prospective national importance of the specific proposed endeavor.

Can entrepreneurs qualify for NIW?

Potentially. The analysis focuses on the proposed endeavor, the person’s ability to advance it, and the benefit of waiving the ordinary job-offer and labor-certification requirements—not on a business title alone.

Is NIW the same as EB-1A?

No. They are different immigrant classifications with different eligibility and evidentiary frameworks. A person may evaluate both, but strength under one does not automatically establish the other.

Describe your situation and the decision you need to make.

For an initial inquiry, briefly describe:

  • Who needs assistance and the immigration goal or problem.
  • The person’s current location and status, relevant work or family facts, and any previous filing.
  • Any government notice, planned start date, travel date, or deadline.

A short summary is enough. Send no passport numbers or confidential documents.
