Green card process inside the United States

Adjustment of status requires more than filing Form I-485.

For eligible applicants already in the United States, adjustment of status can lead to lawful permanent residence without completing the immigrant-visa process abroad. The route depends on the immigrant category, visa availability, manner of entry, immigration history, and admissibility.

The immigrant basis, entry history, admissibility, and supporting records must form one consistent adjustment case.

The threshold questions come first

  • Is there a valid family-based, employment-based, or other qualifying immigrant basis?
  • Is an immigrant visa immediately available, or does a priority date control filing?
  • Does the applicant’s entry, status history, or unauthorized employment affect eligibility?
  • Could inadmissibility, prior filings, removal history, or misrepresentation create a separate issue?

Build one consistent record

  • Coordinate the immigrant petition and adjustment application when concurrent filing is permitted.
  • Document the qualifying relationship or immigrant category and continuing eligibility.
  • Prepare identity, entry, status, financial, medical, and civil records required for the case.
  • Anticipate biometrics, requests for evidence, interview preparation, and related work or travel applications.
01

Confirm that adjustment is legally available

Physical presence in the United States does not by itself make adjustment available. The analysis begins with the immigrant category, visa availability, inspection or parole history, and any category-specific exceptions to status-maintenance or unauthorized-employment restrictions.

The petition and Form I-485 may sometimes be filed together, but concurrent filing is a timing rule rather than a substitute for eligibility. Priority dates, derivative relationships, age calculations, and changes in the petitioner’s status can alter when or whether the application may proceed.

02

Reconstruct every entry, status period, and prior filing

Passports, I-94 records, approval notices, visa applications, employment records, and prior immigration filings should be reconciled before submission. Overstays, unauthorized employment, prior removal proceedings, false claims, inconsistent answers, or departure after unlawful presence may require separate legal analysis.

The application becomes a consolidated immigration record. Names, addresses, family history, memberships, employment, arrests, and prior benefits should remain consistent with the underlying petition and government records or be explained directly.

03

Plan life while the application is pending

A pending adjustment case may involve separate applications for employment authorization and advance parole. Filing or approval of one document does not necessarily resolve the consequences of travel, employment, loss of another status, or a change in the underlying relationship or job.

Biometrics, medical documentation, requests for evidence, interviews, and agency notices require active monitoring. Applicants should also understand which changes must be reported and which facts could affect continuing eligibility before the final decision.

Facts and procedure determine the route.

Eligibility cannot be determined from physical presence in the United States alone. Departing while an application is pending, filing after status violations, or overlooking an inadmissibility issue can have serious consequences. The controlling rules vary by immigrant category and individual history.

Issues to resolve before filing.

Does filing Form I-485 give lawful status?

A pending adjustment application and lawful immigration status are not identical concepts. The legal effect depends on the applicant’s history and category, and a pending filing does not cure every prior violation.

Can an applicant travel while Form I-485 is pending?

Travel can affect a pending adjustment case. Many applicants need advance parole before departure, while separate rules or exceptions may apply to certain classifications. Travel should be reviewed before leaving the United States.

Can work begin after filing?

Filing Form I-485 does not automatically authorize employment. An applicant generally needs independent work authorization or an approved employment authorization document before working.

Is an interview always required?

USCIS decides whether an interview is necessary. Preparation remains important because an interview may examine eligibility, admissibility, the underlying petition, and consistency of the record.

Describe your situation and the decision you need to make.

For an initial inquiry, briefly describe:

  • The family relationship or immigration issue and who is seeking assistance.
  • Your current location and status, relevant immigration history, and forms already filed.
  • Any interview, notice, decision, or deadline that needs attention.

A short summary is enough. Send no passport numbers or confidential documents.
