EB-2 NIW RFE responses

An NIW RFE response must define the proposed endeavor precisely and prove every step of the waiver analysis.

USCIS may question the underlying advanced-degree or exceptional-ability qualification, the endeavor’s substantial merit and national importance, whether the petitioner is well positioned to advance it, or whether waiving the job offer and labor certification would benefit the United States. Evidence for one issue does not automatically establish the others.

The underlying EB-2 qualification, proposed endeavor, national importance, positioning, and waiver balance require separate proof.

Identify which NIW layer is actually disputed

  • Confirm that the record independently establishes the threshold EB-2 classification before addressing the waiver.
  • Define the proposed endeavor as the specific future work—not only the petitioner’s occupation, industry, employer, or broad social problem.
  • Separate substantial merit from national importance and distinguish the endeavor’s prospective impact from the importance of the field generally.
  • Analyze the petitioner’s education, skills, record of success, progress, plan, support, resources, and realistic path under the well-positioned prong.

Build proof around the endeavor and the petitioner

  • Use a concise endeavor statement consistent with the petition, personal plan, expert evidence, business or research materials, and proposed U.S. activities.
  • Document prospective impact through credible market, policy, economic, scientific, health, educational, operational, geographic, or other relevant evidence.
  • Show progress and capacity through achievements, adoption, contracts, grants, funding, intellectual property, publications, partnerships, customers, pilots, letters of interest, or implementation records as applicable.
  • Explain why the United States would benefit from waiving the normal job-offer and labor-certification requirements in this particular case.
01

The occupation is not the proposed endeavor

A profession such as engineer, physician, entrepreneur, researcher, or consultant is too broad by itself. The response should identify what the petitioner intends to do, for whom or through what mechanism, at what scale, and toward what prospective result.

Changing the endeavor materially in response to an RFE can create a filing-date problem. Clarification should remain grounded in the work proposed when the petition was filed.

02

National importance concerns prospective impact

Merit may exist in business, science, culture, health, education, technology, or other areas, but national importance requires a separate examination of the endeavor’s potential broader implications. The importance of an industry or shortage alone does not necessarily prove the petitioner’s endeavor has national importance.

The response should avoid unsupported claims of job creation, economic scale, policy effect, or nationwide reach. Projections need assumptions, evidence, and a credible mechanism connecting planned activity to asserted impact.

03

Being well positioned does not require guaranteed success

USCIS evaluates factors such as education, skills, knowledge, record of success, a plan for future activities, progress, and interest or support from relevant entities. The question is whether the petitioner is well positioned, not whether success is certain.

Letters are strongest when they explain specific knowledge, independent interest, prior results, concrete support, or planned collaboration. Generic praise does little to prove progress or feasibility.

Facts and procedure determine the route.

Do not use a new RFE response to replace the original endeavor with a more attractive project. Eligibility must exist at filing, and the forms, petition letter, plan, expert evidence, and supplemental record must remain materially consistent.

Issues to resolve before filing.

Does a graduate degree automatically qualify someone for NIW?

No. It may establish the underlying EB-2 classification, but the petitioner must separately satisfy all three national-interest-waiver prongs.

Must the endeavor create jobs?

No universal job-creation requirement applies to NIW, although credible economic or employment effects may be relevant in some cases.

Are recommendation letters required?

There is no fixed universal number. Specific, credible letters can support the record, but objective evidence and a coherent endeavor remain essential.

Can an RFE response change the proposed endeavor?

It may clarify the endeavor, but a material replacement can raise whether eligibility existed on the filing date.

Describe your situation and the decision you need to make.

For an initial inquiry, briefly describe:

  • Who needs assistance and the immigration goal or problem.
  • The person’s current location and status, relevant work or family facts, and any previous filing.
  • Any government notice, planned start date, travel date, or deadline.

A short summary is enough. Send no passport numbers or confidential documents.
